Designs

Design rights are becoming increasingly important as an IP asset. In many cases, they form the core of a protection strategy, but they can also complement an IP strategy consisting of trademark rights, copyrights, and Unfair Competition Law claims (UWG). We support the development of design rights and related strategies, research potentially conflicting prior rights, handle registration procedures in Germany and abroad, and assist in the enforcement and defense of design rights.

Our consulting services also include representation in court, e.g., in summary proceedings (preliminary injunctions) and in main proceedings, as well as before the relevant Offices. We appear before the German Patent and Trademark Office (DPMA) and the European Union Intellectual Property Office (EUIPO) ourselves. In other jurisdictions, we draw on a proven network of colleagues abroad. These proven collaborations enable us to secure designs in almost any country and defend the corresponding rights before the competent courts. Our experience in combating counterfeiting/product piracy and in EU border seizures complements the enforcement of our clients’ rights.
