Trademarks

A trademark is both a statement and an important asset. We support the development and launch of brands and associated brand strategies, research potentially conflicting prior rights, handle national and international trademark registration procedures, and assist in enforcing and defending trademark rights at home and abroad.

Our range of services includes the defence against trademark claims, including representation in court, e.g. in summary proceedings (preliminary injunctions) and in main proceedings, insofar as, for example, injunctive relief or damages are claimed. If, following a warning letter, there is a threat of preliminary injunction proceedings being initiated, we will file a protective letter if necessary.

In addition, we represent our clients in so-called administrative proceedings before the respective trademark offices. We appear in person before the German Patent and Trademark Office (DPMA) and the European Union Intellectual Property Office (EUIPO). In other jurisdictions, we draw on a proven network of colleagues abroad. This network enables us to register trademarks in almost any country and defend them before the competent courts. Our experience in combating product piracy and in EU border seizures complements the enforcement of our clients’ rights.
