A sudden or age-related illness, an accident or absence due to holiday may cause that people are no longer able to manage their personal and legal affairs themselves and are dependent on the assistance of others. A power of attorney, e.g. in the form of a general and precautionary power of attorney with a supplementary guardianship order and living will, can provide a solution.

A general and precautionary power of attorney (“General- und Vorsorgevollmacht”) authorises one or more person to act on behalf of another person. A guardianship order (“Betreuungsverfügung”) regulates the unlikely but conceivable case that, despite the granting of a general and precautionary power of attorney, the guardianship court must exceptionally decide on a matter of representation. A living will (“Patientenverfügung”) allows you to specify treatment wishes towards doctors. Corresponding powers of attorney, certified or notarised by a notary, ensure that trusted persons can act on behalf of those affected in these situations. In this way, legal guardianship can be avoided. Upon request, we can register the documents with the Central Advance Directive Register (“Zentrales Vorsorgeregister”) of the Federal Chamber of Notaries (“Bundesnotarkammer”).
