Legal Services

ERLBURG is an independent law firm specialising in Intellectual Property (IP). We advise our national and international clients on Trademark Law, Design Law, Unfair Competition Law and Copyright Law, and also have expertise in Media Law.

Our services include advising on operational issues relating to Intellectual Property and representing clients in proceedings before courts (litigation) and trademark offices (administrative/office proceedings). In addition, we develop strategies for establishing and defending IP rights and implement these strategies together with our clients. Brand portfolio management is an essential part of our work in this area. We secure and defend IP rights for clients nationally, within the EU and internationally, in particular trademarks and designs. We also advise on Copyrights, including Licensing issues and Anti-Piracy. In countries where we are not able to practise law ourselves, we rely on proven partner law firms or coordinate legal advice abroad.

Expertise:

  • IP-Litigation including extra-judicial representation of clients in relation to Intellectual Property rights (warning letters, preliminary injunction proceedings, main action proceedings)
  • Brand Portfolio Management including Trademark Prosecution and Design Prosecution (e.g. application, opposition and further office procedures before Intellectual Property Offices like DPMA and EUIPO)
  • Development and enforcement of IP strategies/advice on product launches (naming, IP registrations in relevant local markets, enforcement of IP rights)
  • Trademark and design availability searches/pre-rights and delimitation agreements
  • Anti-Piracy/Anti-Cybersquatting including Customs seizures
