Copyrights

Creativity deserves protection: whether it’s texts, photographs, music, films or product design, Copyright Law protects Intellectual Property with its broad scope of application and ensures that creative work is not used unlawfully. It plays a key role in the exploitation of creative works, both offline and online.

We advise on the creation of copyright-protected works and provide legal support for the subsequent exploitation processes. This includes advising and representing clients in the negotiation of contracts and the granting of rights of use, exploring legal exceptions to copyright protection, and the possible supplementation of copyright protection with other Intellectual Property Rights (e.g. trademarks, designs).

If copyrights are infringed, we enforce or defend claims both in and out of court. In addition to advising and representing clients in warning letter proceedings, our range of services also includes representation in court, e.g. in summary proceedings (preliminary injunctions) and in main proceedings, insofar as, for example, injunctive relief or damages are claimed.

Expertise:

  • Examination of copyright protection eligibility
  • Advice and representation in copyright disputes (authorisation requests/warnings)
  • Litigation in copyright disputes (preliminary injunction proceedings, main action proceedings)
  • Contract drafting/licensing of copyrights/transfer of rights
  • Publishing contracts
