With further provisions of the EU AI Act coming into force on 2 August 2026, the legal requirements regarding the disclosure of AI use are set to become stricter. The focus is on transparency and labelling requirements, although these will only apply to certain applications.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Contrary to what is sometimes suggested, companies will not be required to label content created using AI per se from the cut-off date onwards. Whether a disclosure regarding the use of AI is required depends rather on the specific area of application of the AI content and the nature of the AI-generated content. The decisive factor is whether the use of AI poses a risk that users may be misled as to the origin or authenticity of content.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>No general labelling requirement for AI content<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">But what specific content must now be labelled?<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>This applies to chatbots and virtual assistants, provided that it is not immediately apparent to the user that they are such.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It also covers artificially generated or manipulated image, audio and video content (deepfakes). If content is created or altered in such a way that it appears authentic and depicts real people or events, this must be clearly indicated. AI-generated advertising videos, artificially generated voice-overs or interviews created or manipulated using AI may be affected by this regulation.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Disclosure requirements may also apply to AI-generated texts in specific cases. However, this does not apply to all text content. Labelling is particularly relevant where content is made available to the public for information purposes and has not undergone any final human review beforehand. This is therefore conceivable for journalistic content created entirely by AI without editorial review. By contrast, there is no legal obligation to label traditional corporate communications, advertising copy or blog posts.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The transparency obligations apply to content made publicly available from 2 August 2026 onwards, or to existing content where it is substantially altered after that date.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What are the risks of non-compliance?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Companies should take the new requirements seriously, as breaches of the transparency obligations under the EU AI Act may result in fines. In addition, where labelling is insufficient, claims may arise for breaches of Unfair Competition Law (UWG) and Data Protection Regulations. Finally, claims for damages under general Civil Law may arise if customers or business partners suffer loss or damage due to a lack of labelling. This could occur, for example, if AI-generated content gives the impression of originating from real people and certain business transactions are carried out on that basis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Conclusion:<\/strong>&nbsp;On 2 August 2026, key provisions of the EU AI Act will come into force, which relate to transparency obligations for certain uses of AI. Companies should review their AI applications against the new requirements at an early stage and implement appropriate compliance measures. Ensuring the legally compliant implementation of these transparency obligations not only minimises the risks of fines and liability but also strengthens the trust of customers and business partners in the responsible use of artificial intelligence.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Chatbots, automated text generation, image generators and AI-powered marketing campaigns \u2013 companies are now using artificial intelligence in a variety of areas.
