{"id":1449,"date":"2026-02-18T15:41:38","date_gmt":"2026-02-18T14:41:38","guid":{"rendered":"https:\/\/www.erlburg.law\/?p=1449"},"modified":"2026-09-12T19:39:21","modified_gmt":"2026-09-12T17:39:21","slug":"generalvollmacht-basics","status":"publish","type":"post","link":"https:\/\/www.erlburg.law\/en\/generalvollmacht-basics","title":{"rendered":"\u201cGeneralvollmacht\u201d\u2013 Basics"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>A general power of attorney (\u201cGeneralvollmacht\u201d) is a common component under German Law to make provision for unforeseen circumstances, sickness and older age that require representation by another person. It ensures that a trusted person can act on behalf of the principal in important legal, financial or health matters. Such power of attorney is often combined with additional declarations like a care directive (\u201cBetreuungsverf\u00fcgung\u201d) and a living will (\u201cPatientenverf\u00fcgung\u201d). It can only be granted by the principal in person, and the person must have full legal capacity when signing it. In this blog post, we provide a brief overview on the possible content of a general power of attorney and explain the difference between notarisation and notarial certification of general powers of attorney.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">1. <strong>What is a general power of attorney?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A general power of attorney is a declaration that combines representation in property\/financial and health matters. With the help of such powers of attorney, one or more persons are authorised to act on behalf of the principal. The power of attorney can cover various areas, e.g. asset management (e.g. the purchase\/sale of real estate), contracts, banking transactions and even representation before authorities and courts. In addition, health care powers of attorney usually also cover representation in health matters and designate who should act in medical and care matters in the event of incapacity to make decisions. In combination with a living will, specific instructions regarding medical treatment and accommodation can be provided.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Scope of the power of attorney:<\/strong>&nbsp;The purpose of a general power of attorney is usually that it applies generally, i.e. to all conceivable transactions. It is therefore common for such a power of attorney to be granted without restriction in external relations (\u201cim Au\u00dfenverh\u00e4ltnis unbeschr\u00e4nkt\u201d). This mechanism enables the authorised representative to act comprehensively and appropriately for the principal in any given situation, should this become necessary. However, the unrestricted scope is not a dogma. Certain legal transactions or health decisions can be excluded but this should be carefully considered in the process of granting it.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Rights and obligations of the authorised representative:&nbsp;<\/strong>Internally, a general power of attorney is usually limited. It is only granted in cases where (i) the principal instructs that it should be used or (ii) the principal is no longer able to act on their own behalf. When exercising the power of attorney, the authorised persons are also obliged to act in the best interests of the principal. Otherwise, this may be regarded as an abuse of the power of attorney.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Selection of authorised representatives:<\/strong>&nbsp;Ideally, at least one substitute should be named in addition to the (main) authorised representative in case the original authorised representative is no longer able or willing to act for any reason. It is important that the authorised representatives enjoy the full trust of the principal. Particular care should therefore be taken when selecting authorised representatives. The authorised representatives should also be aware of the wishes of the person granting the power of attorney. If the relationship of trust with the persons named in the power of attorney has ended at some point, the general power of attorney should be revoked.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">2. What is a care directive or living will?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A care directive (\u201cBetreuungsverf\u00fcgung\u201d) and a living will (\u201cPatientenverf\u00fcgung\u201d) can supplement a general power of attorney. In practice, a general power of attorney is often combined with these additional dispositions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Care directive:<\/strong>&nbsp;The care directive regulates the (unlikely but conceivable) case that, despite the granting of general and health care power of attorney, the guardianship court must exceptionally decide on a matter of representation. In combination with a general power of attorney and a health care proxy, a guardianship order is therefore a kind of \u2018emergency solution\u2019 if the desired representation by the health care proxy fails and the guardianship court orders guardianship after all. In a guardianship order, a person can be named for this case who is to be appointed as guardian by the guardianship court. Often, these are the persons who are also appointed as authorised representatives in the general and health care proxy. In addition, specific instructions to the guardian can be included in the guardianship order, which must be observed in this case.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Living will:&nbsp;<\/strong>A living will allows you to specify whether and under what circumstances you wish to consent to or prohibit future medical treatments such as health examinations, therapeutic treatments or medical interventions. The principle of specificity applies here. The living will must outline the future situation to which it refers as specifically as possible. In addition, specific instructions for action must be specified.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">3. <strong>General legal requirements<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The persons granting the power of attorney must have full legal capacity (\u201cvolle Gesch\u00e4ftsf\u00e4higkeit\u201d) when establishing the general power of attorney. This implies they must understand the meaning and scope of the declaration as such and its contents. The power of attorney must also be granted by the persons granting the power of attorney themselves. The signing by another person is not possible. In addition, the power of attorney must, of course, be granted voluntarily and without external pressure.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">4. <strong>Notarial certification or notarial authentication?&nbsp;<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Powers of attorney can be drawn up in the form of a private document, i.e. a simple signature under the power of attorney document would suffice. However, such purely handwritten powers of attorney are not always accepted, as there is no guarantee that the person named in the power of attorney declaration has made the declaration. For reasons of reliability, certain declarations therefore require a prior notarisation of the power of attorney (notarial certification or notarisation). This applies, for example, to real estate transactions and declarations to the commercial register. In addition, even banks often require at least a certified power of attorney.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>This raises the question whether a general power of attorney should (only) be certified by a notary or if a notarisation makes sense.<\/strong>&nbsp;In principle, a certified power of attorney allows all conceivable legal transactions to be carried out on behalf of a third party. A notarial certification is also cheaper than a notarisation in most cases. Nevertheless, a notarisation offers various advantages over a certification:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Legal certainty:<\/strong>&nbsp;A notarisation ensures that the principal was legally competent when granting the power of attorney and was fully informed about the meaning and scope of their decision. This must be verified as part of the notarisation process. This removes any doubts about the validity of the power of attorney that can arise in the context of a notarial certification (where the level of verification is limited).&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Acceptance by third parties:<\/strong>&nbsp;Notarial certification is the strictest formal requirement provided for by law. A notarised power of attorney therefore enjoys a very high level of trust.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Issuing copies:<\/strong>&nbsp;A notarised document can be reproduced if required. If the original document is lost or if several copies of the powers of attorney are required to handle various parallel legal transactions, this is still possible later if the power of attorney has been notarised.&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A notarised and a notarised general power of attorney (with\/without a care directive\/living will) can be deposited in the Central Register of Lasting Powers of Attorney (\u201cVorsorgeregister\u201d). Depositing these documents is voluntary, but often makes sense, as it ensures knowledge of guardianship courts and treating physicians of the existence of such document. Depositing the power of attorney at the register incurs a one-time fee of at least EUR 20.50, which can increase to approximately EUR 40.00 depending on the number of designated trusted persons.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Conclusion:&nbsp;<\/strong>A general power of attorney and health care proxy is an essential tool for ensuring that your wishes are carried out even if you are temporarily or permanently unable to make decisions. In practice, a general power of attorney and health care proxy is often supplemented by a guardianship order or living will. The power of attorney should be clear in its content, the person granting the power of attorney must have full legal capacity when granting the power of attorney, and it must be granted voluntarily. Whether notarisation of the power of attorney document is sufficient or whether notarisation makes sense should be clarified on a case-by-case basis.
